What Does the Asylum Process Involve?

If you want to apply for asylum, you must prove that you are either a refugee who cannot or will not go back to your home country due to actual or potential persecution based on your race, religion, political opinion, or nationality. Persecution can also happen if you belong to a specific social group. Economic hardship is not a valid ground on which you can apply for asylum.

You must apply for asylum within one year of entry into U.S. territory. If you are already in the U.S., you can apply for Affirmative Asylum. For which the United States Citizenship and Immigration Services, also known as USCIS, requires you to file form I-589.

If you are an asylum seeker outside of the U.S. and do not currently hold a valid visa, you can claim asylum at a U.S. port of entry. This type of asylum is called Defensive Asylum, which is a more complex process.

If the USCIS approves your petition for asylee status, you can lawfully live and work in the U.S. You do not have to go back to your country of origin. This applies to any spouse or child you included in your application. You and family members approved for asylum may eventually request an adjustment of status to lawful permanent residents, also known as green cardholders.
