E-2 Investor Visa for Temporary Status

To qualify for an E-2 visa, you must be a citizen from one of the 80 countries that the United States accepts for investment opportunities. If so, you must have invested or be in the process of investing a significant amount of capital in an American business. You must own at least 50% of the company and generate sufficient profits to make an impact on local communities in the U.S.

Your purpose for applying for an E-2 investor visa is to come to U.S. territory to develop the business. You must do so through a managerial role in the company or another acceptable corporate role. An E-2 investor visa is valid for five years and you may apply for as many two-year renewals as necessary to operate the business. However, you must continue to demonstrate your intention to leave the United States once you have reached your goals with the company.

If you are an essential employee for the business, you may qualify for an E-2 visa too for an initial period of two years with an unlimited number of potential extensions if you maintain your immigration status.

An E-2 visa allows you to bring your spouse and any unmarried children under 21 as dependents when you move to the U.S. They do not need to be citizens of the treaty country. Your spouse can receive a work permit and your children can attend school during your family’s stay in the U.S.

EB-5 Immigrant Investor Visa for Lawful Permanent Residence

As an investor, you may also opt to apply for an EB-5 investor visa for lawful permanent residence, a type of employment-based green card. Your purpose to seek this immigration status is to create and develop a business in the U.S. that results in both capital and employment for U.S. citizens and lawful permanent citizens.

USCIS requires applicants to make at least one of the following investments without borrowing:

• $1,800,000
• $900,000 in a rural area
• $900,000 in an area with a high rate of unemployment

If you meet those criteria, you can fill out and submit Form I-526: Immigrant Petition by Alien Entrepreneur. If the USCIS approves your request, you can apply for your green card at your local U.S. Embassy or Consulate.

If you have a spouse and/or unmarried children under 21, you can include them as dependent as part of your immigrant visa application.

An EB-5 investor visa offers all green card benefits, including:
